1. Seller

The online store "Rozemarijn Naturalcare" is operated by Rozemarijn Naturalcare and is located at Anna van Schuumanstraat 350, 5344 TV, Oss (Netherlands) with VAT number NL001758818B44 ("Seller"). The activities fall under the principle of 'distance selling' which regulates the general terms and conditions of sale as follows: The customer confirms that at the time of purchase, he/she has read these terms and conditions of sale and declares to agree to them without any reservation. For all legal relationships between Rozemarijn Naturalcare on the one hand and the customer on the other hand, the following provisions apply unless explicitly agreed otherwise in writing. After the conclusion of a sales agreement, these are supplemented by our general contract conditions as stated on our order forms and invoices.

2. Offer and Agreement

2.1 All offers from Rozemarijn Naturalcare are without obligation, and Rozemarijn Naturalcare expressly reserves the right to withdraw offers. All offers are subject to availability. Price changes are reserved at all times. 2.2 An agreement is concluded after acceptance of the order by Rozemarijn Naturalcare. Rozemarijn Naturalcare is entitled to refuse orders or to attach certain conditions to the delivery. 2.3 The administration of Rozemarijn Naturalcare and/or that of the used delivery service serves, unless proven otherwise, as proof of the orders placed and payments made by the customer to Rozemarijn Naturalcare, and of deliveries made by Rozemarijn Naturalcare. Rozemarijn Naturalcare acknowledges that electronic communication can serve as proof. By accepting these terms, the customer also acknowledges this. 2.4 All images, data regarding weights, dimensions, colors are approximate only. Deviations from reality cannot give rise to compensation and/or dissolution.

3. Prices

The stated prices for the offered products are in Euros, including VAT and excluding shipping costs or other levies unless otherwise stated or agreed upon in writing. Any shipping costs will be shown during the ordering process. After checking out the items, you will receive an order confirmation. Rozemarijn Naturalcare will also send a confirmation by e-mail with the order number. Special offers are only valid while supplies last.

4. Payment

Rozemarijn Naturalcare delivers an order after receipt of payment. Payment can be made in one of the ways indicated during the ordering process. You can pay by Ideal, Visa and Paypal, among others. If you choose prepayment, please transfer your payment to account number (IBAN: NL04INGB0109703650) in the name of Rozemarijn Naturalcare, stating your order number. If a payment after delivery is not received by Rozemarijn Naturalcare within 21 days, the claim will be handed over for collection. All associated administrative costs and extrajudicial collection costs will be borne by the buyer.

5. Shipping & Delivery

The shipping costs for the Netherlands and other destinations can be found in the webshop. All orders are shipped via insured PostNL, DPD or DHL. The choice of shipping method and packaging is determined by us. The rate for shipping and packaging is €7.75 throughout the Netherlands, regardless of the order size. Rozemarijn Naturalcare aims to ship an order within 14 working days of receipt of payment to the specified address. The maximum delivery period is 21 days. Rozemarijn Naturalcare reserves the right to make partial deliveries so that an order is sent in two or more shipments. Exceeding the 21-day delivery period gives the right to cancel the order. Exceeding any delivery period does not give you the right to compensation in any case.

6. Dissatisfaction & Exchange Guarantee

6.1 The customer has the obligation to examine whether the products comply with the agreement upon delivery. If a delivery does not meet the expectations that can reasonably be placed on the item based on the information provided by Rozemarijn Naturalcare, this must be communicated in writing (by e-mail or post) and with reasons within 7 days of receipt of the order. All correspondence must be conducted stating the order number and delivery address. Rozemarijn Naturalcare will try to resolve the complaint as soon as possible, but no later than within 10 working days. If it has been shown that the products do not comply with the agreement, Rozemarijn Naturalcare has the choice to replace the relevant products with new products upon return thereof, or to refund the invoice value thereof. 6.2 Products developed are quality products that have been formulated and tested without causing animal suffering. All products are natural-based, dermatologically, clinically and allergy-tested. We guarantee all our products. If for any reason you are not satisfied with the purchase of a product, you can return it to us under certain conditions in exchange for a new product or for a refund within a certain period. The shipping costs for returns are for the account of the buyer. Possible reasons for return are: · The delivered item does not match the ordered item · You have an allergic reaction to the product (upon presentation of a doctor's certificate) If you wish to make use of this money-back guarantee, please contact us via info@rozemarijn-naturalcare.nl  Please state clearly in your email what the problem is. We will contact you as soon as possible.

7. Cancellation

As soon as the customer has received the ordered product, there is a legal possibility to dissolve the underlying agreement with Rozemarijn Naturalcare within 7 days of reflection period. The customer does not have to state a reason for this. If the customer wishes to dissolve the agreement within this period, the customer must inform Rozemarijn Naturalcare in writing (e-mail, letter). After consulting Rozemarijn Naturalcare, the customer must send the product to a return address determined by Rozemarijn Naturalcare. In this case, the customer must bear the costs and risks of shipping. If the customer has already made any payments at the moment the customer has revoked the agreement with Rozemarijn Naturalcare as a result of the foregoing of these general terms and conditions, Rozemarijn Naturalcare will refund these payments within 14 working days after receipt of the returned product. Rozemarijn Naturalcare reserves the right to refuse returned products or to credit only a part of the already paid amount, if there is a suspicion that the product has already been opened and more than ⅓ of the product has been used or has been damaged due to the fault of the customer.

8. Retention of Title

As long as Rozemarijn Naturalcare has not received full payment regarding the goods of an agreement, the delivered goods remain the property of Rozemarijn Naturalcare and it has the right to reclaim these goods and take possession of them if the defaulting client fails to fulfill his obligations, if he liquidates, applies for or has obtained a moratorium, is declared bankrupt or if the goods are seized.

9. Liability

The utmost care has been taken in compiling the content of the website and other informational material. However, it is possible that certain information is not complete or available, is incorrect, or becomes outdated over time. All information, products, and services are offered without any guarantee as to their soundness, suitability for a specific purpose, or otherwise. Rozemarijn Naturalcare is therefore not liable for direct or indirect damage resulting from the use of information, products, or services obtained through this website or hyperlinks. Rozemarijn Naturalcare is not liable for any consequences of delayed delivery of an order or the inability to deliver ordered items. Rozemarijn Naturalcare can only be held liable for damage attributable to its intent or gross negligence up to a maximum of the invoice value.

10. Force Majeure

Rozemarijn Naturalcare is not obliged to fulfill any obligation towards the customer if it is prevented from doing so due to circumstances not attributable to its fault, nor for its account by law, legal act or generally accepted views.

11. Privacy

Rozemarijn Naturalcare treats personal data with the utmost care and will never offer it to third parties. Personal data will be included in a mailing list, if desired, which has been compiled to make new offers in the future. This mailing list will only be used by Rozemarijn Naturalcare. If at any time such an offer is not appreciated, it is always possible to indicate this in writing (by e-mail or post). The data will then be immediately removed from the mailing list.

12. Applicable law and competent court

12.1 All rights, obligations, offers, orders and agreements to which these Conditions apply, as well as these Conditions, are exclusively governed by Dutch law. 12.2 All disputes between parties will exclusively be submitted to the competent court in the Netherlands.

Right of withdrawal

Upon delivery of products:

  1. When purchasing products, the consumer has the option to dissolve the agreement without giving reasons for a period of 14 days. This reflection period commences on the day after receipt of the product by the consumer or a representative designated in advance by the consumer and made known to the entrepreneur.
  2. During the reflection period, the consumer will handle the product and its packaging with care. He will only unpack or use the product to the extent necessary to assess whether he wishes to keep the product. If he exercises his right of withdrawal, he will return the product with all supplied accessories and - if reasonably possible - in its original condition and packaging to the entrepreneur, in accordance with the reasonable and clear instructions provided by the entrepreneur.
  3. If the consumer wishes to exercise his right of withdrawal, he is obliged to make this known to the entrepreneur within 14 days after receiving the product. The consumer must do this by means of the model form or by means of another communication method such as e-mail. After the consumer has indicated that he wishes to exercise his right of withdrawal, the customer must return the product within 14 days. The consumer must prove that the delivered goods have been returned in time, for example by means of a proof of shipment.
  4. If the customer has not made known his intention to exercise his right of withdrawal or has not returned the product to the entrepreneur after the periods mentioned in paragraphs 2 and 3, the purchase is final.

Upon delivery of services:

  1. When services are delivered, the consumer has the option to dissolve the agreement without stating reasons for at least 14 days, starting on the day the agreement is entered into.
  2. To exercise his right of withdrawal, the consumer will adhere to the reasonable and clear instructions provided by the entrepreneur with the offer and/or at the latest upon delivery.

Costs in case of withdrawal

  1. The consumer bears the direct costs of returning the product.
  2. If the consumer has paid an amount, the entrepreneur will refund this amount as soon as possible, but no later than 14 days after withdrawal. This is subject to the condition that the product has already been received back by the web retailer or conclusive proof of complete return can be provided. Reimbursement will be made via the same payment method used by the consumer, unless the consumer explicitly gives permission for another payment method.
  3. In the event of damage to the product due to careless handling by the consumer, the consumer is liable for any depreciation of the product.
  4. The consumer cannot be held liable for the depreciation of the product if the entrepreneur has not provided all legally required information about the right of withdrawal before the conclusion of the purchase agreement.

Exclusion of the right of withdrawal

  1. The entrepreneur can exclude the consumer's right of withdrawal for products as described in paragraphs 2 and 3. The exclusion of the right of withdrawal only applies if the entrepreneur has clearly stated this in the offer, or at least in good time before the conclusion of the agreement.
  2. Exclusion of the right of withdrawal is only possible for products:
    • that have been created by the entrepreneur according to the consumer's specifications;
    • that are clearly personal in nature;
    • that cannot be returned due to their nature;
    • that spoil or age quickly;
    • whose price is subject to fluctuations in the financial market over which the entrepreneur has no influence;
    • for loose newspapers and magazines;
    • for audio and video recordings and computer software of which the consumer has broken the seal;
    • for hygiene products of which the consumer has broken the seal.
  3. Exclusion of the right of withdrawal is only possible for services:
    • concerning accommodation, transport, restaurant business or leisure activities to be carried out on a specific date or during a specific period;
    • whose delivery has commenced with the express consent of the consumer before the reflection period has expired;
    • concerning bets and lotteries.
